Punjab and Haryana High Court Hears Tax Audit Due Date Extension Case
The Punjab and Haryana Court, after hearing the case, Ashwini Kumar vs Central Board of Direct Taxes (CBDT), has told the Department’s counsel to get clear instructions from the CBDT by 26th September 2025. The court has made it clear that if no proper reply is given before this deadline, the court will pass appropriate orders on its own.
The writ petition was filed requesting an extension of the Tax Audit Report submission due date. This year, many professionals and taxpayers have raised several challenges that are affecting the accurate and timely compliance. As per the representations submitted by these professionals and taxpayers, the e-filing utilities were released late, disturbing the normal time gap.
Apart from this, the glitches on the income tax e-filing portal, such as pre-filed data errors, upload errors, and server errors, have also added difficulties. Also, the heavy rains and floods in several regions of India have disrupted electricity and internet.
During these situations, it is not easy to file Audit Tax Reports before the due date. With this order of the High Court, many taxpayers and professionals in the country are waiting for the next decision and hoping the court will consider the genuine hardships and rule in favour of all taxpayers and professionals. If the high court gives more time to file the Tax Audit Report, it will provide much-needed relief to taxpayers and professionals, allowing them to complete their work correctly without being pressured.
