ROC Imposes Penalty on Directors for Holding Two DINs

The Registrar of Companies (ROC), Patna, has issued a penalty order against two directors of a company for holding an extra Director Identification Number (DIN).

DIN is a mandatory, unique 8-digit identification number issued to directors of a company by the Ministry of Corporate Affairs (ROC). However, as per Section 155 of the Companies Act, 2013, directors are not allowed to apply, obtain, or hold more than one DIN.

The two directors of Ranisati Agro Products were mistakenly allotted two DINs. While they were filing the DIR KYC web form for one of their DINs, the system showed an error, and they were informed that their PAN was linked to another DIN.

The directors claimed that they filed DIR-5 to surrender their extra DIN, but it was sent for resubmission. Therefore, they filed suo-motu applications accepting their violation and offered to pay the compounding charges.

For violating Section 155 of the Companies Act, the ROC levied a penalty of Rs 50,000 each on its two directors. They must pay the penalty within 90 days via the MCA e-Adjudication facility on the MCA Portal.
